WHEREAS, Plaintiff filed this putative class action on May 23, 2012;

WHEREAS, on May 30, 2012, Plaintiff served defendant Barbara’s Bakery, Inc.

(“Defendant”) with the summons and complaint;

WHEREAS, Plaintiff filed a first amended complaint on June 28, 2012;

5

WHEREAS Defendant filed its answer to the first amended complaint on July 19, 2012.

WHEREAS, Plaintiff seeks to amend the first amended complaint to state additional claims for

relief;
THEREFORE, the parties stipulate and request that the Court order that Plaintiff file his
second amended complaint, and Defendant will have 21 days from the filing of the first amended

complaint to respond.
