Case No. 12-cv-02819-MMC
ORDER DENYING AS MOOT
DEFERRED PORTION OF PARTIES’
JOINT ADMINISTRATIVE MOTION
AND STIPULATION TO FILE UNDER
SEAL
Re: Dkt. No. 204
12
13
Before the Court are a Joint Administrative Motion and Joint Stipulation, both filed
14
November 14, 2016, by which the parties seek leave to file under seal a USB drive
15
containing material that, according to the parties, comprises the full scope of evidence
16
relevant to the above-titled action.
17
On July 13, 2017, the Court issued an order granting in part and deferring ruling in
18
part on the parties’ joint motion, and, with regard to the materials as to which the Court
19
deferred ruling, directed any party seeking sealing of those materials to file, no later than
20
July 20, 2017, a declaration establishing a basis for sealing. On July 20, 2017, the
21
parties filed a joint notice, wherein the parties “agree[d] that the documents identified in
22
the July 13, 2017 order do not contain confidential information” and, in accordance
23
therewith, publicly filed those documents as Exhibits A-E to their joint notice. (See Joint
24
Notice, filed July 24, 2017, at 3:7-8, Exs. A-E.)
25
Accordingly, to the extent the parties initially sought an order sealing the
26
documents attached as Exhibits A through E to their joint notice, their Joint Administrative
27
Motion to file under seal is hereby DENIED as moot, and, as the non-confidential
28
materials included on the USB drive have been filed in the public record, the USB drive
1
and its contents may remain under seal.
