Colvin became the Acting Commissioner of Social Security on February 14, 2013. Pursuant to Rule 25(d) of the Federal Rules of Civil Procedure, Carolyn W. Colvin should be substituted for Michael J. Astrue as the defendant in this suit. 1 Case3:12-cv-03349-EMC Document30 Filed08/28/13 Page2 of 3 1 2 3 The parties stipulate, through their undersigned counsel, subject to the Court’s approval, to the late filing of this stipulation. The late filing is necessary due to the facts 4 5 6 7 that: (1) Defendant’s counsel was no longer listed as an ECF recipient and only learned of the motion recently; (2) the parties needed additional time to settle the matter. The parties further stipulate, through their undersigned counsel, subject to the 8 9 Court’s approval, that Plaintiff be awarded attorney fees under the Equal Access to 10 Justice Act (EAJA), 28 U.S.C. § 2412(d), in the amount of FIVE THOUSAND 11 DOLLARS ($5,000.00). This amount represents compensation for all legal services 12 13 14 15 16 rendered on behalf of Plaintiff by counsel in connection with this civil action, in accordance with 28 U.S.C. § 2412(d). After the Court issues an order for EAJA fees to Plaintiff, the government will consider the matter of Plaintiff’s assignment of EAJA fees to Bay Area Legal Aid. 17 18 Pursuant to Astrue v. Ratliff, 130 S.Ct. 2521 (2010), the ability to honor the assignment 19 will depend on whether the fees are subject to any offset allowed under the United States 20 Department of the Treasury’s Offset Program. After the order for EAJA fees is entered, 21 22 23 24 the government will determine whether they are subject to any offset. Fees shall be made payable to Plaintiff, but if the Department of the Treasury determines that Plaintiff does not owe a federal debt, then the government shall cause the 25 26 payment of fees to be made directly to Bay Area Legal Aid, pursuant to the assignment 27 executed by Plaintiff. Any payments made shall be delivered to Bay Area Legal Aid. 28 2 Case3:12-cv-03349-EMC Document30 Filed08/28/13 Page3 of 3 1 This stipulation constitutes a compromise settlement of Plaintiff's request for 2 EAJA attorney fees and expenses, and does not constitute an admission of liability on the 3 part of Defendant under the EAJA.
