On January 23, 2013, upon granting Defendant’s motion to dismiss, the Court dismissed

17

this matter. On February 6, 2013, this Court received notice of appeal and what appears to be

18

an application to proceed in forma pauperis on appeal. See Fed. R. App. P. 24(a). 28 U.S.C.

19

1915(a)(3) provides that an appeal may not be taken in forma pauperis if the district court

20

certifies that it is taken in bad faith. The Court concludes that the appeal is not taken in good

21

faith and DENIES the application to proceed in forma pauperis on appeal.
