On January 23, 2013, upon granting Defendant’s motion to dismiss, the Court dismissed

17

this matter. On February 6, 2013, this Court received notice of appeal and what appears to be

18

an application to proceed in forma pauperis on appeal. See Fed. R. App. P. 24(a). On February

19

13, 2013, the Court denied the request. On February 22, 2013, the Court received a formal

20

application to proceed in forma pauperis. 28 U.S.C. 1915(a)(3) provides that an appeal may not

21

be taken in forma pauperis if the district court certifies that it is taken in bad faith. The Court

22

concludes that the appeal is not taken in good faith and again DENIES the application to

23

proceed in forma pauperis on appeal.
