L.R. 6-2 AND 7-12 1 thirty -five (35) day continuance of the hearing date for Tesoro/Safeco 2 and Motion to Strike 3 Butte as follows: RECITALS 4 1. McD filed its complaint on or about July 12, 2012. 5 2. Butte Steel filed an answer to the complaint and a crossclaim against Tesoro and 6 Safeco on October 5, 2012. 7 3. 8 Motion to Strike 9 are currently set for hearing on December 4, 2012. 10 4. Tesoro and Safeco filed a Motion to Dismiss Crossclaim and a Answer and Crossclaim on October 29, 2012. These two motions At the initial Case Management Conference held on October 16, 2012, Magistrate 11 Judge Laporte referred this case to Magistrate Judge Jacqueline Scott Corley for Settlement 12 Conference to be scheduled within ninety (90) days. 13 5. All counsel participated in an initial ADR telephone conference call with 14 Magistrate Judge Corley on October 29, 2012, and a second follow-up ADR telephone 15 conference call with Judge Corley on November 16, 2012. 16 6. During the November 16, 2012 ADR telephone conference call, all parties agreed 17 teel 18 19 7. Additionally, principal representatives of Butte Steel and Tesoro have agreed to 20 meet on November 28, 2012 to discuss disputed issues and documents, in conjunction with and 21 as a part of 22 negotiations in this case. 23 8. ongoing ADR settlement conference in this case, to further settlement Magistrate Judge Corley has scheduled a follow up ADR telephone conference on 24 December 3, 2012 to evaluate the status of settlement discussions and progress following the 25 meeting between the principals of Butte Steel and Tesoro, and to schedule an ADR Settlement 26 Conference. 27 28 9. hearing on December 4, 2012. 2 3:12-CV-03638-EDL STIPULATION TO CONTINUE HEARING DATE AND [PROPOSED] ORDER CIV. During the November 16, 2012 ADR telephone conference call, Magistrate Judge 4 Corley recommended, and counsel for Tesoro and Butte Steel agreed, to continue the hearing 5 date for Tesoro/Safeco 6 to continue, without unnecessarily expending both the court 7 preparing and filing T 8 hearing on Tesoro/Safeco motions. 9 12. 10 time and resources in reply briefs for the two motions, and in preparing for the All parties desire to continue the hearing on T motions to allow further 11 to Dismiss and Motion to Strike, to allow settlement discussions conference. 12 settlement 13.
