On October 19, 2012, this Court issued an ORDER GRANTING DEFENDANT’S

APPLICATION TO PROCEED IN FORMA PAUPERIS; AND DISMISSING COMPLAINT

WITH LEAVE TO AMEND directing Plaintiff Lee Valvis to file an amended notice of removal by

19

November 19, 2012, otherwise, the case will automatically be dismissed with prejudice and the case be

20

deemed remanded. As of this day, Plaintiff did not file such amended notice of removal. It is hereby

21

ordered that the case is dismissed with prejudice and be remanded to state court. The Clerk of the Court

22

is directed to close this case.
