On December 21, 2012, Defendant filed a Motion for Judgment on the Pleadings 5 and Motion to Dismiss pursuant to Rules 12(c) and 12(h)(3). Defendant’s motion 6 is scheduled to be heard by the Court on February 8, 2013. 7 2. In light of holiday schedules and attorney absences, the parties have agreed to give 8 each side additional time to file their respective opposition and reply papers. 9 3. Accordingly, the parties have agreed to extend Plaintiff’s deadline to oppose the 10 motion from January 4, 2011, to January 11, 2013; and agreed to extend 11 Defendant’s deadline to reply to Plaintiff’s opposition to the motion from January 12 11, 2013, to January 25, 2013. 13 4.
