WHEREAS Magistrate Judge Elizabeth LaPorte has agreed to preside over a
Settlement Conference in this matter scheduled for August 6, 2014; and

WHEREAS in anticipation of the September 22, 2014 trial date, a Pretrial
Conference has been set for August 25, 2014; and

WHEREAS substantial effort, and accompanying expense, will need to be

undertaken in connection with the August 25, 2014 Pretrial Conference, including serving

7

in limine motions in advance of the Settlement Conference scheduled for August 6, 2014;

and

WHEREAS the parties believe that time and resources would be better directed at
settlement efforts at this time;

THE PARTIES HEREBY STIPULATE as follows:

1. That the trial date in this matter be continued until November 3, 2014; and

13

2. That all other scheduled dates, including but not limited to the Pretrial

14

Conference presently scheduled for August 25, 2014, be rescheduled accordingly.
