No. C 12-05602 RS CASE MANAGEMENT SCHEDULING ORDER ZORAN CORPORATION, Defendant. ____________________________________/ Pursuant to Rule 16(b) of the Federal Rules of Civil Procedure, the parties attended a 18 Case Management Conference on February 28, 2013. After considering the Joint Case 19 Management Statement submitted by the parties and consulting with the attorneys of record for 20 the parties and good cause appearing, IT IS HEREBY ORDERED THAT: 21 1. 22 PRIVATE MEDIATION. The parties agree to participate in mediation about 90 days 23 ALTERNATIVE DISPUTE RESOLUTION. following the issuance of a claim construction order. 24 2. INITIAL DISCLOSURES. Initial disclosures shall be made by May 6, 2013. 25 3. DISCOVERY. Discovery related to claim construction shall be limited as 26 follows: (a) ten (10) non-expert depositions per party; (b) twenty-five (25) interrogatories per 27 party, including all discrete subparts; (c) a reasonable number of requests for production of 28 CASE MANAGEMENT SCHEDULING ORDER documents or for inspection per party; and (d) a reasonable number of requests for admission per 2 party. 4. 3 DISCOVERY DISPUTES. Discovery disputes will be referred to a Magistrate 4 Judge. After the parties have met and conferred, the parties shall prepare a joint letter of not 5 more than 8 pages explaining the dispute. Up to 12 pages of attachments may be added. The 6 joint letter must be electronically filed under the Civil Events category of "Motions and Related 7 Filings >Motions--General > Discovery Letter Brief." The Magistrate Judge to whom the matter 8 is assigned will advise the parties of how that Judge intends to proceed. The Magistrate Judge 9 may issue a ruling, order more formal briefing, or set a telephone conference or a hearing. The dates proposed by the parties leading up to the Markman Hearing on pages 9-10 of their Joint Case Management are adopted as follows: A. 14 On or before May 28, 2013 Disclosure of Asserted Claims and Infringement 15 Contentions, and accompanying documents in the form and with the content required by Patent 16 L.R. 3-1 and 3-2 shall be served. B. 17 18 in the form and with the content required by Patent L.R. 3-3 and 3-4 shall be served. C. 19 20 On or before July 26, 2013, the parties are to exchange claim terms needing construction in the form and with the content required by Patent L.R. 4-1. D. 21 22 On or before July 12, 2013, Invalidity Contentions, and accompanying documents On or before August 7, 2013, all parties shall be joined and pleadings shall be complete, as required by Patent L.R. 16-10(b). On or before November 15, 2013 the Responsive Claim Construction Brief shall be filed pursuant to Patent L.R. 4-5(b). J. On or before November 22, 2013, the Reply Claim Construction Brief shall be filed pursuant to Patent L.R. 4-5(c). 6. TUTORIAL. A tutorial for the Markman Hearing shall be held on December 27, 13 2013 at 10:00 a.m. in Courtroom 3, 17th Floor, United States Courthouse, 450 Golden Gate 14 Avenue, San Francisco, California. 15 7. MARKMAN HEARING. A Markman Claim Construction Hearing shall held on 16 January 3, 2014 at 10 a.m. in Courtroom 3, 17th Floor, United States Courthouse, 450 Golden 17 Gate Avenue, San Francisco, California.
