remaining cause of action but preserves the Plaintiffs’ right to appeal causes of action that the Court
dismissed on December 24, 2014, including the Court’s conclusion that Plaintiffs cannot obtain

WHEREAS the Parties are in the process of drafting and executing formal settlement
documents;
