No. 201), the Court heard argument 2 on multiple discovery issues (Dkt. Nos. 193, 195, 197, 199, 205) on November 21, 2014. After 3 considering the parties’ written and oral submissions, the Court orders: 4 5 1. QDI will produce the following additional information/documents: a. Final versions of the PowerPoints identified in items (1)-(3) of Plaintiffs’ 6 opening brief on the McKinsey issue (Dkt. No. 193). QDI may also provide 7 a basis for additional redactions over which the parties will meet and confer. 8 b. Full time-series of Fee Schedules 11, 66, and 70 from 2007 to the present. 9 c. Data and documents sufficient to show prices, variable costs, fixed costs, and 10 quantity for Quest’s top 100 tests in California from 2007 to the present. 11 12 13 14 15 d. Documents sufficient to show accounts taken from Plaintiffs during the relevant time period. e. E-Account Reports showing pricing approvals for green, yellow, red, and brown approvals in California during the relevant time period. f. A full set of the P&Ls for the IPA accounts subject to the Court’s prior order. 16 The parties will work together to identify any deficiencies in the time-series 17 of the P&L’s produced pursuant to the order. Quest will look in the files, 18 both custodian and central, most likely to have additional responsive 19 information to address any such deficiencies. 20 21 22 23 g. Documents sufficient to show profitability for the Aetna and Blue Shield of California contracts. 2. QDI will produce the following deponents (but need not produce any documents for these deponents): 24 a. Gary McCabe. 25 b. Tim Sharpe (deposition limited to four hours; QDI may submit additional 26 documentation explaining why another deponent other than Tim Sharpe 27 should be sufficient; Plaintiffs may submit additional information supporting 28 their position). 1 JOINT ORDER REGARDING ISSUES HEARD ON NOVEMBER 21, 2014 3:12-CV-05847-WHO 1 3. Hunter will produce the following additional information/documents: 2 a. Complete set of fee schedules. 3 b. Native versions of the cash collections report. 4 c. Income statements 5 4. Plaintiffs will produce the following deponents: 6 a. Hunter witness to discuss lost accounts (deposition limited to two hours). 7 b. Hunter or Seacoast witness to discuss additional financial documents 8 (deposition limited to two hours). 9 c. RDL witness regarding lost accounts. 10 11 5. All administrative motions to file under seal submitted in connection with these discovery issues are GRANTED. (Dkt. Nos. 193, 197, 199). 12 6. Remainder of motions denied. 13 7.
