1 2 3 UNITED STATES DISTRICT COURT 4 NORTHERN DISTRICT OF CALIFORNIA 5 6 STEPHEN REID, Case No. 12-cv-06230-JST Plaintiff, 7 ORDER TO FILE STIPULATION OF DISMISSAL v. 8 9 CIGNA LIFE INSURANCE COMPANY OF NEW YORK, 10 Defendant. United States District Court Northern District of California 11 Re: ECF No. 25 Plaintiff stated on the record on August 19, 2013, that the parties have settled this action. 12 See ECF No. 25. Accordingly, all deadlines and hearings in this case are VACATED. By 13 October 3, 2013, the parties shall file either a stipulated dismissal or a one-page joint statement 14 explaining why they failed to comply with this Order. 15 The parties should be aware that, unless there is good cause for continuing federal court 16 supervision over a case, it is not the undersigned’s normal practice to exercise continuing 17 jurisdiction over a settlement agreement or to issue an injunction which has the effect of making 18 the violation of an agreement a federal cause of action. See, e.g., Regents of the Univ. of 19 Calif. v. International Medical Group, Inc., Case No. 3:12-cv-00048-JST, Order Denying Request 20 to Retain Jurisdiction over Settlement Agreement, ECF No. 53 (N.D. Cal. July 9, 2013). If the 21 parties request that the Court exercise such jurisdiction, the request should also explain the 22 unusual circumstances that justify departure from this general rule. 23 24 25 26 27 28 Any continuance of the deadline set in this Order requires a showing of good cause. Failure to comply with that deadline may result in sanctions. IT IS SO ORDERED. Dated: August 20, 2013 ______________________________________ JON S. TIGAR United States District Judge
