COUNTY OF SAN DIEGO, et al., 13 ORDER TO SHOW CAUSE AND VACATING CASE MANAGEMENT CONFERENCE Defendant. / 14 15 This matter is set for a hearing on August 23, 2013 on the motion to dismiss filed by the 16 County of San Diego. Pursuant to Local Civil Rule of the Northern District 7-3, an opposition 17 or statement of non-opposition to this motion was due to be filed and served by May 29, 2013. 18 To date, Plaintiff has not filed an opposition or statement of non-opposition. 19 Plaintiff is HEREBY ORDERED TO SHOW CAUSE (“OSC”) in writing, by June 20, 20 2013, why the pending motion to dismiss should not be granted in light of his failure to file a 21 timely opposition or statement of non-opposition. If Plaintiff seeks to file a substantive 22 response to the County’s motion, Plaintiff must demonstrate good cause for failing to file his 23 opposition brief in a timely fashion. In his response to this OSC, Plaintiff is also directed to 24 show cause why this case should not be dismissed for failure to prosecute. Plaintiff is 25 admonished that his failure to respond this Order by June 20, 2013, will result in a dismissal of 26 this action without further notice. 27 /// 28 /// 1 If Plaintiff files a substantive response to Defendants’ motion and demonstrates good 2 cause for his delay, the Court will provide Defendants an opportunity to file a reply brief by no 3 later than June 28, 2013. 4 The Court FURTHER ORDERS that the case management conference set for June 14, 5 2013 is VACATED. The Court will reset the case management conference at a later date, if 6 necessary. 7 The Court advises Plaintiff that the Handbook for Pro Se Litigants, contains helpful 8 information about proceeding without an attorney, is available through the Court’s website or in 9 the Clerk’s office. The Court also advises Plaintiff that he also may wish to seek assistance from the Legal Help Center.
