Now pending before the Court is Defendants’ motion to dismiss filed on February 4,

15

2013. On March 13, 2013, the Court, Magistrate Judge Jacqueline Scott Corley presiding,

16

issued an order to show cause why this action should not be dismissed for failure to prosecute.

17

The Court has received no submission from Plaintiff, either in response to the motion to dismiss

18

or the order to show cause. Thereafter, this matter was reassigned to another district court judge

19

and then transferred to the undersigned.

20

In order to make certain that Plaintiff has adequate notice of potential dismissal after

21

transfer of this matter to three judges, Plaintiff is HEREBY ORDERED TO SHOW CAUSE in

22

writing no later than May 13, 2013, as to why this case should not be dismissed for failure to

23

prosecute. Failure to respond to this Order by that date shall result in dismissal of this matter

24

without prejudice.
