On January 30, 2013, Plaintiff Lucila Mariano filed the above-captioned complaint, as well

13

as an application to proceed in forma pauperis. On February 11, 2013, the Clerk of Court directed

14

Plaintiff to either consent or decline magistrate jurisdiction by February 22. Dkt. No. 4. Plaintiff

15

failed to respond.

16

Based on this inaction, the Court hereby ORDERS Plaintiff Lucila Mariano to show cause

17

why this case should not be dismissed for failure to prosecute and failure to comply with court

18

deadlines. Plaintiff shall file a declaration by March 28, 2013. If a responsive declaration is filed,

19

the Court shall either issue an order based on the declaration or conduct a hearing on April 11, 2013

20

at 10:00 a.m. in Courtroom B, 15th Floor, 450 Golden Gate Avenue, San Francisco, California.

21

Notice is hereby provided to Plaintiff that the Court may dismiss the case without a hearing if a

22

responsive declaration is not filed. Thus, it is imperative that Plaintiff file a written response by the

23

deadline above.
