1 2 3 4 UNITED STATES DISTRICT COURT 5 NORTHERN DISTRICT OF CALIFORNIA 6 7 KIMBERLY CARTER, et al., Case No. 13-cv-00809-JCS Plaintiffs, 8 v. ORDER RE DOCKET NO. 145 9 NATIONAL RAILROAD PASSENGER CORPORATION, et al., 11 United States District Court Northern District of California 10 Defendants. 12 13 On July 10, 2014, the parties submitted a Joint Letter addressing discovery issues. The 14 Court construes the letter as a motion to compel (“Motion”). For the following reasons, the 15 Motion is DENIED. First, the parties have not met and conferred in person as required by the 16 Court’s previous orders. Second, Plaintiffs have not identified any specific questions, answers, or 17 objections or instructions not to answer at depositions that were not answered or were improper. 18 Third, Plaintiffs have not identified specific document requests or any specific responsive 19 documents they contend Defendants failed to produce. In light of this lack of specificity, the 20 Court cannot decide whether any further discovery is warranted. Finally, to the extent that the 21 joint letter complains that certain depositions took place late in discovery, this argument is now 22 largely moot because the depositions have been taken. In any event, both sides bear some 23 responsibility for the fact that document production and depositions occurred at the end of 24 discovery. 25 26 27 28 IT IS SO ORDERED. Dated: July 18, 2014 ______________________________________ JOSEPH C. SPERO United States Magistrate Judge
