1 2 IN THE UNITED STATES DISTRICT COURT 3 FOR THE NORTHERN DISTRICT OF CALIFORNIA 4 No. C-13-0860 TEH (PR) KENNETH GIBBS, 5 Plaintiff, 6 ORDER DISMISSING CLAIM AGAINST DEFENDANT ACOSTA v. 7 CARSON, et al., (Doc. # 26) 8 Defendants. / 9 United States District Court For the Northern District of California 10 On April 1, 2013, Plaintiff filed a civil rights complaint 11 12 under 42 U.S.C. § 1983 against thirty-nine named Defendants. 13 #9. 14 Claims against eleven Defendants. 15 Court found that Plaintiff had stated a cognizable claim for 16 excessive force against Defendant Sgt. Acosta. Doc. On May 8, 2013, the Court issued an Order Serving Cognizable Doc. #16. In that Order, the Doc. #16 at 11. Plaintiff has filed a letter stating that Sgt. Acosta did not 17 18 use excessive force against him. 19 Plaintiff’s motion to voluntarily dismiss the claims against Sgt. 20 Acosta and grants this motion. 21 request, the excessive force claim against Sgt.
