On May 29, 2013, the Court granted Wells Fargo’s motion to dismiss Jones’
17 complaint under Federal Rule of Civil Procedure 12(b)(6). Dkt. No. 22. The Court gave
18 Jones until June 19, 2013 to amend his complaint to cure its deficiencies and warned that
19 failure to amend would result in dismissal of his case with prejudice. Id. This deadline has
20 passed, and Jones not amended his complaint. Accordingly, for the reasons set forth in the
21 Court’s May 29, 2013 order granting Wells Fargo’s motion to dismiss, the Court dismisses
22 this case with prejudice.

The case management conference set for July 31, 2013 is vacated. Wells Fargo’s
24 motion to appear at the conference by telephone is denied as moot. Dkt. No. 21. The clerk
25 is ordered to terminate case No. 13-cv-00903 NC.
