FINANCIAL INSURANCE COMPANY, an AXA FINANCIAL COMPANY, settled this matter

on or about June 23, 2014;

WHEREAS Defendant CIGI DIRECT INSURANCE SERVICES was previously
dismissed by the Court on March 10, 2014;

THEREFORE, IT IS HEREBY STIPULATED by and between Plaintiff and U.S.
6
FINANCIAL LIFE INSURANCE COMPANY through their designated counsel that the above-
7
captioned action should be dismissed with prejudice pursuant to FRCP 41(a)(1)(A). The parties
8
further stipulate that the parties shall bear their own attorney’s fees, expenses and costs.
