Shirt) (collectively referred to herein as “the Parties”) hereby stipulate and agree as follows:

WHEREAS the Case Management Conference in this case was initially scheduled for
September 13, 2013 at 8:30 a.m.;
WHEREAS the Court continued that Case Management Conference to October 11, 2013,

per the Parties’ stipulation, so that the parties could engage in mediation with mediator Mark

LeHocky on October 8, 2013 at 10 :00 a.m. in San Francisco, California. (ECF 44).

WHEREAS the parties agree that should the case not settle at mediation on October 8, 2013,

they will need additional time to meet and confer to prepare a Joint Case Management Conference

Statement.

WHEREAS the parties agree that, for the sake of judicial economy, it makes sense to
continue the Case Management Conference from October 11, 2013, to November 1, 2013.
THE PARTIES HEREBY STIPULATE and agree that, subject to the Court’s approval, the

Case Management Conference be continued to November 1, 2013 at 8:30 a.m., or as soon thereafter

as can be heard by the Court.
