Plaintiff’s letter filed on September 12, 2013 is construed as a motion for
15
reconsideration of the court’s August 12, 2013 order of dismissal and is
16
DENIED. Despite plaintiff’s citing of earlier cases to the contrary, it is now well
17
established that even when a prisoner seeks relief not available in grievance
18
proceedings, notably money damages, exhaustion is a prerequisite to suit. See
19
Porter v. Nussle, 534 U.S. 516, 524 (2002); Booth v. Churner, 532 U.S. 731, 741
20
(2001).
