The parties agree that Plaintiff is entitled to an award of attorney’s fees and expenses to

be paid by the Defendant pursuant to the Equal Access to Justice Act (EAJA), 28 U.S.C. § 2412,

23

subject to any allowable offset under the Department of the Treasury’s Offset Program. See

24

Astrue v. Ratliff, 130 S.Ct. 2521 (2010).

25

The parties agree that an award of attorney’s fees in the amount of $5292.66 shall be

26

awarded to Plaintiff. If it is determined that Plaintiff’s EAJA fees are not subject to any offset

27

allowed under the Department of the Treasury’s Offset Program, then the check for EAJA fees

28

shall be made payable to Plaintiff’s attorney, Cynthia G. Starkey, based upon Plaintiff’s
assignment of these amounts to Plaintiff’s attorney.

Finally, the parties agree that whether the check is made payable to Plaintiff, or to
Cynthia G. Starkey, the check shall be mailed to Plaintiff's attorney at the following address:

Based upon the Stipulation of the parties, the Equal Access to Justice Act (EAJA), 28

U.S.C. § 2412, and Plaintiff’s EAJA petition, it is hereby ordered that EAJA attorney’s fees of

17

$5292.66 shall be awarded to Plaintiff, unless there is an allowable offset under the Department

18

of the Treasury’s Offset Program. See Astrue v. Ratliff, 130 S.Ct. 2521 (2010). There are no

19

costs or expenses.
