(“McWane”) in the above-captioned action respectfully submit this stipulation 3 as follows: 4 5 6 WHEREAS, GCM and McWane Inc. (collectively, the “Parties”) have been working together in good faith to reach a settlement in this action; WHEREAS, the Parties have already exchanged and are currently working 7 on the terms of what they anticipate will be a final settlement agreement for 8 approval by the Court; 9 WHEREAS, the Court set the Initial Case Management Conference in this 10 matter for Friday, November 22, 2013 at 10:00 am before the Honorable Samuel 11 Conti upon reassignment. 12 WHEREAS, the Joint Case Management Conference Statement and Rule 13 26(f) Report shall be submitted seven days prior to the Case Management 14 Conference; 15 16 17 18 19 20 WHEREAS, the Parties shall make initial disclosures or state objections in their Rule 26(f) Report one week before the Case Management Conference. WHEREAS, the Parties have been working together in good faith to reach a settlement in this action; WHEREAS, the Parties desire to continue negotiating a settlement in good faith and anticipate reaching a final settlement in this action; 21 NOW, THEREFORE, THE PARTIES STIPULATE AS FOLLOWS: 22 1. The Case Management Conference shall be continued to Friday, January 23 24 25 17, 2014 at 10:00 am or as soon thereafter as the Court is available. 2.
