ORDER OF DISMISSAL 6 7 UNITED STATES, et al., Defendant. 8 9 10 The Court has been advised that the parties have agreed to settle this case, and are now in United States District Court Northern District of California 11 the process of preparing a settlement agreement. Therefore, it is ORDERED that this case is 12 DISMISSED without prejudice. All deadlines and hearings in the case are vacated. Any pending 13 motions are moot. The parties retain the right to reopen this action within 60 days of this Order if 14 the settlement is not consummated. If a request to reinstate the case is not filed and served on 15 opposing counsel within 60 days, the dismissal will be with prejudice. 16 17 18 IT IS SO ORDERED.
