STIPULATED MOTION TO DISMISS WITH PREJUDICE
Plaintiffs Arczar, LLC and Geovector Corporation (collectively, “Plaintiffs”) on the one hand,

and Defendant Nintendo of America, Inc. ("Nintendo") on the other hand, pursuant to Fed. R. Civ.
13
P.4l(a)(2) and (c), hereby move for an order dismissing all of Plaintiffs' claims in this action and all of
14
Nintendo's counterclaims in this action WITH PREJUDICE, subject to the terms of that certain
15
agreement entitled "SETTLEMENT, RELEASE, AND LICENSE AGREEMENT" and dated May 26,
16
2014, with each party to bear its own costs, expenses and attorneys' fees.

CAME ON THIS DAY for consideration of the Stipulated Motion for Dismissal With Prejudice
of all claims by Plaintiffs Arczar, LLC and Geovector Corporation ("Plaintiffs") and all counterclaims by

Defendant Nintendo of America, Inc. ("Nintendo") in this case, and the Court being of the opinion that
said motion should be GRANTED, it is hereby

ORDERED, ADJUDGED AND DECREED that all claims asserted in this suit by Plaintiffs

against Nintendo and all counterclaims by Nintendo against Plaintiffs are hereby DISMISSED WITH
9
PREJUDICE, subject to the terms of that certain agreement entitled "SETTLEMENT, RELEASE, AND
10
LICENSE AGREEMENT" and dated May 26, 2014.

It is further ORDERED that all attorneys' fees, costs, and expenses are to be borne by the party
