WHEREAS, Plaintiffs Aleta Lilly and David Cox (“Plaintiffs”) filed a Motion

for Class Certification on February 3, 2014.
WHEREAS, Defendants Jamba Juice Company’s and Inventure Foods, Inc.’s

(“Defendants”) Response to the Motion for Class Certification is due on May 16,
5
2014.

WHEREAS, Plaintiffs and Defendants participated in an all-day mediation on
7
March 31, 2014 with Catherine Yanni of JAMS; no agreement was reached at the
8
mediation, but the parties have continued discussions with Ms. Yanni by telephone.

WHEREAS, Defendants have asked to take the depositions of Plaintiffs.

Plaintiff David Cox has been involved in a car accident and is undergoing therapy. As
11
a result, he will not be available for deposition until some time in May 2014.
