The parties to this Action, Plaintiff and Counter-Defendant CORE Method, LLC and

Defendant and Counter-Plaintiff PROBAR, LLC (collectively the “parties”) have reached a

settlement of all claims and counterclaims in this Action. Pursuant to Federal Rule of Civil

Procedure 41, the parties hereby stipulate as follows:

1. All claims and counterclaims in this action are dismissed with prejudice, with each party
to bear its own fees and costs.
2. The Court shall retain jurisdiction to enforce the terms of the parties’ settlement

agreement.
