On December 30, 2013, the Court issued an Order to Show Cause why this case should

17

not be dismissed based on Plaintiff’s failure to file a timely opposition to the pending motion to

18

dismiss and for failure to prosecute. The Court further ordered that Plaintiff’s response to the

19

Order to Show Cause was due by January 13, 2014, and that if he failed to file a response to the

20

Order to Show Cause by January 13, 2014, the Court would dismiss this case. To date, Plaintiff

21

has not filed any response either to the pending motion to dismiss or to the Order to Show

22

Cause. Accordingly, the Court DISMISSES this action for failure to prosecute pursuant to

23

Federal Rule of Civil Procedure 41(b). The Clerk is directed to close the file.
