This is a civil rights case filed pro se by a detainee. On January 15, 2014, court
13
found that plaintiff had failed to state a claim and dismissed the amended complaint with
14
leave to amend after discussing the deficiencies of the amended complaint. The twenty-
15
eight days to amend has passed and plaintiff has not filed a second amended complaint or
16
otherwise communicated with the court. This case is DISMISSED for failure to state a
17
claim upon which relief can be granted.
