No. C 13-05102 RS CASE MANAGEMENT SCHEDULING ORDER EUGENE WONG, CONNIE CHAN, DAVID 14 CHUN, WILLIAM “BILL” WONG, MATTHEW TSAI, LELAND WONG, UMC 15 FOOD CORPORATION, and DOES 1 through 20 16 17 18 19 Defendants. ____________________________________/ Pursuant to Rule 16(b) of the Federal Rules of Civil Procedure, the parties attended a 20 Case Management Conference on April 3, 2014. After considering the Joint Case Management 21 Statement submitted by the parties and consulting with the attorneys of record for the parties and 22 good cause appearing, IT IS HEREBY ORDERED THAT: 23 1. 24 SETTLEMENT CONFERENCE. The parties are hereby REFERRED to a randomly ALTERNATIVE DISPUTE RESOLUTION. 25 assigned Magistrate Judge for the purpose of engaging in a settlement conference, to take place, 26 ideally, within the next 60 days. 27 2. DISCOVERY. 28 CASE MANAGEMENT SCHEDULING ORDER 1 On or before January 26, 2015 all non-expert discovery shall be completed by the parties. 2 Discovery shall be limited as follows: (a) twenty (20) non-expert depositions per party; (b) sixty 3 (60) interrogatories per party, including all discrete subparts; (c) a reasonable number of requests 4 for production of documents or for inspection per party; and (d) sixty (60) requests for admission 5 per party. 6 3. 7 Discovery disputes will be referred to a Magistrate Judge. After the parties have met and 8 conferred, the parties shall prepare a joint letter of not more than 8 pages explaining the dispute. 9 Up to 12 pages of attachments may be added. The joint letter must be electronically filed under DISCOVERY DISPUTES. the Civil Events category of "Motions and Related Filings >Motions--General > Discovery 11 For the Northern District of California United States District Court 10 Letter Brief." The Magistrate Judge to whom the matter is assigned will advise the parties of 12 how that Judge intends to proceed. The Magistrate Judge may issue a ruling, order more formal 13 briefing, or set a telephone conference or a hearing. After a Magistrate Judge has been assigned, 14 all further discovery matters shall be filed pursuant to that Judge’s procedures. 15 16 17 18 19 20 21 4. EXPERT WITNESSES. The disclosure and discovery of expert witnesses shall proceed as follows: A. On or before December 23, 2014, parties will designate experts in accordance with Federal Rule of Civil Procedure 26(a)(2). B. On or before January 26, 2015, all discovery of expert witnesses pursuant to Federal Rule of Civil Procedure 26(b)(4) shall be completed. 5. FURTHER CASE MANAGEMENT CONFERENCE. A Further Case 22 Management Conference shall be held on December 4, 2014 at 10:00 a.m. in Courtroom 3, 17th 23 Floor, United States Courthouse, 450 Golden Gate Avenue, San Francisco, California. The 24 parties shall file a Joint Case Management Statement at least one week prior to the Conference. 25 6. PRETRIAL MOTIONS. All dispositive pretrial motions must be filed and served 26 pursuant to Civil Local Rule 7. Each party is limited to one motion for summary judgment 27 absent leave of Court. All pretrial motions shall be heard no later than March 26, 2015. 28 CASE MANAGEMENT SCHEDULING ORDER 2 1 7. PRETRIAL CONFERENCE. The final pretrial conference will be held on April 2 30, 2015 at 10:00 a.m., in Courtroom 3, 17th Floor, United States Courthouse, 450 Golden Gate 3 Avenue, San Francisco, California. Each party or lead counsel who will try the case shall attend 4 personally. 5 8. TRIAL DATE.
