STIPULATION REGARDING CASE
MANAGEMENT CONFERENCE
AND ADR
Plaintiff Facebook, Inc. (“Facebook”) and Defendant Christopher Tarquini hereby stipulate
and agree as follow:
WHEREAS, the Court has set a Case Management Conference for October 14, 2014, with a
Case Management Statement due on October 7, 2014.
WHEREAS, the Court and the ADR Program have requested that the parties notify the
Court if they do or do not desire the services of the ADR program by early October.
WHEREAS, the parties are engaged in active settlement discussions and anticipate being
able to resolve this matter by or near the time of the Case Management Conference.

WHEREAS, the parties wish to avoid preparing a Case Management Statement or

burdening the court with a Case Management Conference that is likely to be unnecessary given that

the parties believe they are close to resolving this matter.

WHEREAS, the parties have agreed to postpone the Case Management Conference and its
associated deadlines by two weeks to allow the parties to attempt to resolve this matter.
WHEREAS, the parties have agreed that the services of the Court’s ADR Program are
unnecessary.

IT IS HEREBY STIPULATED AND AGREED to move the case management conference

to October 28, 2014 and the case management statement due date to October 21, 2014, and that the

ADR referral in this matter may be closed.

The Court, having considered the stipulation of the parties, and good cause appearing,

orders that the case management conference be continued to October 28, 2014 and the deadline to

file the case management statement shall be October 21, 2014. The ADR referral in this matter is
23
closed. This order does not affect the other existing case deadlines set by the Court in its Case
24
Management Scheduling Order. See Dkt. No. 38.
