ORDER 6 7 DLA PIPER (US) LLP, Defendant. 8 9 As explained in the Court's order granting the motion to dismiss the original petition, to 11 United States District Court Northern District of California 10 successfully plead subject matter jurisdiction, any amended petition must allege that the arbitrator 12 "recognized" an applicable ERISA rule but then "ignored" that rule. At the hearing, counsel for 13 Jenks should be prepared to answer the following questions with regard to each ERISA error 14 allegedly committed by the arbitrator: 15 Which ERISA rule was the arbitrator required to apply? 16 Where is that rule identified in the amended petition? 17 Where does the amended petition allege that the arbitrator "recognized" this rule? 18 Where does the amended petition allege that the arbitrator "ignored" this rule despite 19 recognizing it? 20 The parties also should be prepared to discuss whether the petition should be dismissed 21 under the Colorado River doctrine. In particular, does the absence of a ruling by the state court on 22 the ERISA questions presented by the amended petition in this case, combined with the fact that 23 the amended petition in this case focuses primarily on the ERISA questions, militate against 24 dismissal under Colorado River? 25 26 27 28 IT IS SO ORDERED.
