1 2 3 4 UNITED STATES DISTRICT COURT 5 NORTHERN DISTRICT OF CALIFORNIA 6 7 RUSSELL E. BURNS, et al., Case No. 13-cv-05647-JSC Plaintiffs, 8 v. ORDER TO SHOW CAUSE 9 10 United States District Court Northern District of California 11 ROMERO GENERAL CONSTRUCTION, et al., Re: Dkt. No. 37 Defendants. 12 13 The Court closed this ERISA case upon receipt of the Plaintiffs’ Notice of Settlement but 14 maintained jurisdiction to enforce the settlement. The parties’ settlement was a Stipulation for 15 Entry of Judgment (“Stipulation”), in which the parties agreed that if Defendants fail to make 16 payments required under the Stipulation or otherwise default on the obligations set forth therein, 17 then fail to cure after notice is provided, then Plaintiffs may file the Stipulation along with a 18 declaration as to the amount due, which shall be sufficient to have judgment entered against 19 Defendants. (Dkt. No. 37-1 ¶ 10(b).) Plaintiffs have filed such declaration seeking entry of 20 judgment against Defendants due to Defendants’ failure to submit the seventh payment pursuant to 21 the Stipulation. (Dkt. No. 37.) Accordingly, Defendants are hereby ORDERED TO SHOW 22 CAUSE by June 24, 2015, why judgment should not be entered against them in the amount set 23 forth in the declaration. 24 25 IT IS SO ORDERED. Dated: June 10, 2015 26 27 28 ________________________ JACQUELINE SCOTT CORLEY United States Magistrate Judge
