The parties, by and through their counsel of record, hereby stipulate to, and respectfully

request that the Court continue the trial date herein, including expert discovery and pretrial

21

conference deadlines, due to the unavailability of two of Plaintiff’s damage experts, Barry Ben-Zion,

22

Ph.D., and Paul Nottingham, M.D., for the trial date currently set on May 26, 2015.

The parties have met and conferred, and have agreed to a trial date in early November, 2015,

or as soon thereafter as the Court is available, and that all pending pretrial deadlines shall be adjusted

26

accordingly. The parties request a November trial date because two of Defendant’s witnesses will be

27

at sea from June through the middle of October.
