On November 4, 2014, Defendant Qi Huan Ruan filed a Notice of Settlement, stating that

13

this case has been settled and requesting 60 days to file a stipulation for dismissal. However, as

14

no dismissal had been filed within 60 days, the Court ordered the parties to file a stipulation for

15

dismissal or joint status report by January 27, 2015. No response has been received.

16

Accordingly, the Court hereby ORDERS Plaintiff Tina W. Gabbrielli to show cause why

17

this case should not be dismissed for failure to prosecute and failure to comply with court

18

deadlines. Plaintiff shall file a declaration by February 18, 2015. If a responsive declaration is

19

filed, the Court shall either issue an order based on the declaration or conduct a hearing on March

20

5, 2015 at 10:00 a.m. in Courtroom B, 15th Floor, 450 Golden Gate Avenue, San Francisco,

21

California. Notice is hereby provided to Plaintiff that the Court may dismiss the case without a

22

hearing if no responsive declaration is filed. Thus, it is imperative that the Court receive a written

23

response by the deadline above.
