No. C 14-00896 RS CASE MANAGEMENT SCHEDULING ORDER UNIVERSAL CABLE HOLDINGS, INC., 14 d/b/a SUDDENLINK COMMUNICATIONS, WENDY PURNELL, CHARLES HARRIS, 15 and DOES 1 through 100, inclusive, 16 Defendants. 17 ____________________________________/ 18 Pursuant to Rule 16(b) of the Federal Rules of Civil Procedure, the parties attended a 19 Case Management Conference on May 29, 2014. After considering the Joint Case Management 20 Statement submitted by the parties and consulting with the attorneys of record for the parties and 21 good cause appearing, IT IS HEREBY ORDERED THAT: 22 1. ALTERNATIVE DISPUTE RESOLUTION. 23 MEDIATION: The parties are hereby REFERRED to the court’s ADR department for 24 the purpose of engaging in mediation to take place, ideally, within the next 120 days. 25 2. AMENDMENT OF THE PLEADINGS. The pleadings may be amended at any 26 time prior to July 16, 2014, without leave from the court. After that date, any amendment must 27 28 CASE MANAGEMENT SCHEDULING ORDER 1 be by stipulation or with leave from the court pursuant to Rule 15 of the Federal Rules of Civil 2 Procedure. 3 3. DISCOVERY. 4 On or before January 30, 2015 all non-expert discovery shall be completed by the parties. 5 Discovery shall be limited as follows: (a) ten (10) non-expert depositions per party; (b) twenty- 6 five (25) interrogatories per party, including all discrete subparts; (c) a reasonable number of 7 requests for production of documents or for inspection per party; and (d) a reasonable number of 8 requests for admission per party. 9 4. DISCOVERY DISPUTES. Discovery disputes will be referred to a Magistrate Judge. After the parties have met and 11 For the Northern District of California United States District Court 10 conferred, the parties shall prepare a joint letter of not more than 8 pages explaining the dispute. 12 Up to 12 pages of attachments may be added. The joint letter must be electronically filed under 13 the Civil Events category of "Motions and Related Filings >Motions--General > Discovery 14 Letter Brief." The Magistrate Judge to whom the matter is assigned will advise the parties of 15 how that Judge intends to proceed. The Magistrate Judge may issue a ruling, order more formal 16 briefing, or set a telephone conference or a hearing. After a Magistrate Judge has been assigned, 17 all further discovery matters shall be filed pursuant to that Judge’s procedures. 18 19 20 21 22 23 24 25 26 27 5. EXPERT WITNESSES. The disclosure and discovery of expert witnesses shall proceed as follows: A. On or before December 19, 2014, parties will designate experts in accordance with Federal Rule of Civil Procedure 26(a)(2). B. On or before January 9, 2015, parties will designate their supplemental and rebuttal experts in accordance with Federal Rule of Civil Procedure 26(a)(2). C. On or before January 30, 2015, all discovery of expert witnesses pursuant to Federal Rule of Civil Procedure 26(b)(4) shall be completed. 6. FURTHER CASE MANAGEMENT CONFERENCE. A Further Case Management Conference shall be held on February 12, 2015 at 10:00 a.m. in Courtroom 3, 28 CASE MANAGEMENT SCHEDULING ORDER 2 1 17th Floor, United States Courthouse, 450 Golden Gate Avenue, San Francisco, California. The 2 parties shall file a Joint Case Management Statement at least one week prior to the Conference. 3 7. PRETRIAL MOTIONS. All dispositive pretrial motions must be filed and served 4 pursuant to Civil Local Rule 7. Each party is limited to one motion for summary judgment 5 absent leave of Court. All pretrial motions shall be heard no later than March 19, 2015. 6 8. PRETRIAL CONFERENCE. The final pretrial conference will be held on May 7 14, 2015 at 10:00 a.m., in Courtroom 3, 17th Floor, United States Courthouse, 450 Golden Gate 8 Avenue, San Francisco, California. Each party or lead counsel who will try the case shall attend 9 personally. 9. TRIAL DATE.
