WHEREAS, on June 26, 2014, the Court ordered the Parties to engage in private mediation by October 24, 2014 (Dkt. No. 23); 2. WHEREAS, the Parties are currently engaged in discovery and are working toward negotiating an ESI agreement and scheduling depositions; 3. WHEREAS, the Parties believe that the mediation will be more productive if it is held after they have conducted ESI discovery and some depositions; 4. WHEREAS, the Parties have not previously requested an extension of the mediation deadline; 5. WHEREAS, the Parties do not believe that an extension of the mediation deadline will affect the Court’s schedule for this case; THEREFORE, the Parties hereby agree and stipulate that the deadline to engage in private mediation be extended to January 30, 2015.
