On April 8, 2014, the defendant filed a motion to dismiss the complaint, but the plaintiff

did not file any opposition within the time to do so. On May 8, 2014, I issued an order to show

15

cause why this case should not be dismissed for failure to prosecute. I required the plaintiff to

16

respond to the order by May 21, 2014; in lieu of a response, the plaintiff could file an opposition

17

to the motion to dismiss by the same date.

The plaintiff has not filed a timely opposition or response to the order to show cause.

Accordingly, I ORDER that this action be dismissed without prejudice for failure to prosecute.

The Clerk is directed to close the file.
