United States District Court Northern District of California 11 12 Plaintiff has failed to file an amended complaint by the deadline. Accordingly, this 13 14 federal civil rights action is DISMISSED without prejudice for failing to respond to the 15 Court’s order, and for failure to prosecute, see Fed. R. Civ. P. 41(b).1 Because this 16 dismissal is without prejudice, plaintiff may move to reopen the action. Any such motion 17 must contain an amended complaint that addresses the deficiencies specified in the Court’s 18 order dismissing the original complaint with leave to amend. The magistrate judge, then, has jurisdiction to issue this order, even though defendants have not been served or consented to magistrate judge jurisdiction. See Neals v.
