Plaintiff also 20 states it intends to file a motion to extend the deadline for service. 21 Under the circumstances, the Court hereby CONTINUES the Case Management 22 Conference from January 23, 2015 to March 27, 2015, at 10:30 a.m. A Joint Case 23 Management Statement shall be filed no later than March 20, 2015. 24 In the event plaintiff has not served defendant by February 2, 2015,1 however, 25 plaintiff is hereby DIRECTED to file, no later than February 9, 2015, a statement indicating 26 why the instant action should not be dismissed without prejudice, pursuant to Rule 4(m) of 27 1 28 The complaint was filed October 2, 2014. In the absence of an order extending the deadline to serve defendant, plaintiff must serve defendant “within 120 days” of October 2, 2014. See Fed. R. Civ.
