(“Defendants”), by and through their respective counsel, hereby stipulate 23 and agree as follows: 24 25 26 27 1. WHEREAS, on or about December 1, 2014, Defendants filed their Motion to Dismiss Plaintiff’s Complaint and all supporting documents (hereinafter “MTD”); 2. WHEREAS, the hearing date for the MTD has currently been scheduled for January 8, 28 1 JOINT STIPULATION TO EXTEND DEADLINE ON RESPONSE TO MTD 1 2015, at 9:00 a.m., in Courtroom F of this court, before the Honorable Magistrate Judge 2 Jacqueline Scott Corley; 3 3. WHEREAS, the Response to the MTD is currently due to be filed by Plaintiff on or before 4 Monday, December 15, 2014; 5 4. WHEREAS, Plaintiff’s counsel has a conflict with other client work on December 15, 6 2014; 7 5. WHEREAS, Defendants’ counsel and Plaintiff’s counsel have agreed that extending the 8 deadline for the filing of Plaintiff’s Response to the MTD for two (2) days to accommodate 9 10 Plaintiff’s counsel’s workload will not prejudice the rights of any of the parties or hinder 11 the effective administration of this case. 12 13 IT IS THEREFORE STIPULATED AND AGREED, by and among Plaintiff and 14 Defendants, as follows: 15 1. The deadline for Plaintiff’s response to the MTD shall be extended, upon the agreement 16 17 and consent of the court, from December 15, 2014 to December 17, 2014; 18 2. Accordingly, the deadline for Defendants’ Reply to Plaintiff’s Response to the MTD shall 19 be extended from December 22, 2014 to December 24, 2014. 20 3.
