CASE MANAGEMENT SCHEDULING ORDER 9 10 11 STANDARD CONSTRUCTION COMPANY OF SAN FRANCISCO, INC, et al., United States District Court Northern District of California Defendants. 12 13 Pursuant to Rule 16(b) of the Federal Rules of Civil Procedure, the parties attended a Case 14 Management Conference on February 12, 2015. After considering the Joint Case Management 15 Statement submitted by the parties and consulting with the attorneys of record for the parties and 16 good cause appearing, IT IS HEREBY ORDERED THAT: 17 1. ALTERNATIVE DISPUTE RESOLUTION. 18 MEDIATION: The parties are hereby REFERRED to the court’s ADR department for the 19 purpose of engaging in mediation to take place, ideally, within the next 90 days. 20 2. DISCOVERY. 21 On or before November 12, 2015 all non-expert discovery shall be completed by the 22 parties. Discovery shall be limited as follows: (a) ten (10) non-expert depositions per party; (b) 23 twenty-five (25) interrogatories per party, including all discrete subparts; (c) a reasonable number 24 of requests for production of documents or for inspection per party; and (d) a reasonable number 25 of requests for admission per party. 26 3. DISCOVERY DISPUTES. 27 Discovery disputes will be referred to a Magistrate Judge. After the parties have met and 28 1 conferred, the parties shall prepare a joint letter of not more than 8 pages explaining the dispute. 2 Up to 12 pages of attachments may be added. The joint letter must be electronically filed under 3 the Civil Events category of "Motions and Related Filings >Motions--General > Discovery Letter 4 Brief." The Magistrate Judge to whom the matter is assigned will advise the parties of how that 5 Judge intends to proceed. The Magistrate Judge may issue a ruling, order more formal briefing, or 6 set a telephone conference or a hearing. After a Magistrate Judge has been assigned, all further 7 discovery matters shall be filed pursuant to that Judge’s procedures. 8 4. 9 The disclosure and discovery of expert witnesses shall proceed as follows: a. On or before August 20, 2015 parties will designate experts in accordance with 10 Federal Rule of Civil Procedure 26(a)(2). 11 United States District Court Northern District of California EXPERT WITNESSES. b. On or before September 17, 2015 parties will designate their supplemental and 12 rebuttal experts in accordance with Federal Rule of Civil Procedure 26(a)(2). 13 c. On or before November 12, 2015, all discovery of expert witnesses pursuant to 14 Federal Rule of Civil Procedure 26(b)(4) shall be completed. 15 16 5. PRETRIAL MOTIONS. 17 All dispositive pretrial motions must be filed and served pursuant to Civil Local Rule 7. 18 Each party is limited to one motion for summary judgment absent leave of Court. All pretrial 19 motions shall be heard no later than December 3, 2015. 20 6. FURTHER CASE MANAGEMENT CONFERENCE 21 A Further Case Management Conference will be held on August 6, 2015 at 10:00 a.m. in 22 Courtroom 3, 17th Floor, United States Courthouse, 450 Golden Gate Avenue, San Francisco, 23 California. 24 7. PRETRIAL CONFERENCE. 25 The final pretrial conference will be held on January 7, 2016 at 10:00 a.m., in Courtroom 26 3, 17th Floor, United States Courthouse, 450 Golden Gate Avenue, San Francisco, California. 27 Each party or lead counsel who will try the case shall attend personally.
