STIPULATION AND PROPOSED ORDER
WHEREAS, on the Parties stipulated to and requested an order continuing the Case
Management Conference until March 30, 2016 (Dkt. No. 39);
WHEREAS, the Court granted the request to continue, but reset the Case Management
Conference to March 24, 2016 (Dkt. No. 40);
WHEREAS, counsel for Defendants, the United States Environmental Protection

Agency and Gina McCarthy, in her official capacity as Administrator of the United States

Environmental Protection Agency (collectively “EPA”), is not available on March 24, 2016

9

because of a vacation planned before the Court reset the Conference; and

10

WHEREAS, all counsel are available on April 14, 2016.

IT IS HEREBY STIPULATED that, pursuant to Civil L.R. 6-2 and for good cause

12

shown, the CMC currently scheduled for March 24, 2016 be postponed until April 14, 2016

13

and the deadline for the parties to file a joint case management conference statement currently

14

scheduled for March 17, 2016, be postponed until April 7, 2016.
