1 2 3 4 UNITED STATES DISTRICT COURT 5 NORTHERN DISTRICT OF CALIFORNIA 6 7 SHEILA ELLIS, Case No. 14-cv-05669-VC Plaintiff, 8 v. ORDER RE MOTION TO WITHDRAW AND STIPULATION TO DISMISS 9 10 JOHNSON & JOHNSON, et al., Defendants. United States District Court Northern District of California 11 12 In this and two other related cases, counsel for the plaintiff have filed a motion to 13 withdraw. In each motion, counsel assert that they have lost contact with the plaintiff. 14 Subsequently, in each of these three cases, counsel for the plaintiff filed a stipulated request to 15 dismiss the case without prejudice. Each stipulated request repeats that counsel for the plaintiff 16 have lost touch with their client. And each stipulated request is worded identically. These filings 17 give rise to a number of questions that prevent this Court from approving the stipulated request for 18 dismissal in this case (or the stipulated request for dismissal in the two related cases). 19 Accordingly, the stipulated request is denied, and counsel for both sides should be prepared to 20 explain, at the hearing on the motion to withdraw, what is going on here. 21 22 23 24 25 26 27 28 IT IS SO ORDERED. Dated: May 28, 2015 ______________________________________ VINCE CHHABRIA United States District Judge
