On October 14, 2016, the Court issued an Order directing the parties to file a joint status

report. Because it will be necessary to divulge sensitive and confidential information in order to

25

update the Court, the parties jointly request that the Court schedule a telephonic conference to

26

discuss the status of the matter. The parties anticipate requesting that Defendant’s time to re-file

27

the Motion for Judgment on the Pleadings be extended to November 18, 2016 to afford the

28

parties the opportunity to complete the process in which they are currently engaged.
