1 2 3 4 UNITED STATES DISTRICT COURT 5 NORTHERN DISTRICT OF CALIFORNIA 6 7 FRANK LUCIDO, et al., 8 Plaintiffs, 9 10 11 ORDER RE PLAINTIFFS’ ADMINISTRATIVE MOTION TO FILE UNDER SEAL v. NESTLE PURINA PET CARE COMPANY, Docket No. 154 Defendant. 12 For the Northern District of California United States District Court Case No. 15-cv-00569-EMC 13 Plaintiffs have moved to file under seal the entirety of their opposition to Purina’s motion 14 for summary judgment as well as a number of supporting exhibits. Plaintiffs indicate that the 15 information contained therein has been designated confidential by Purina. The Court has reviewed 16 the motion. While there appears to be good cause to seal some of the exhibits, the Court has 17 serious questions as to whether all of the exhibits should be filed under seal. Moreover, 18 designating the entirety of the opposition confidential is overbroad. Accordingly, the Court 19 hereby orders the parties to meet and confer to narrow the request for filing under seal. The 20 parties shall file a joint brief to propose a more narrowly tailored request to file under seal. The 21 brief shall be filed within a week of the date of this order. 22 23 24 25 26 27 28 IT IS SO ORDERED. Dated: September 28, 2016 ______________________________________ EDWARD M. CHEN United States District Judge
