TO THIS HONORABLE COURT, PLEASE TAKE NOTICE that the parties in the

above-referenced matter have reached a settlement. By April 28, 2017, or as soon as the

conditions of the settlement agreement have been fulfilled, the parties expect to file a stipulated
4
dismissal with prejudice as to Plaintiff Jamal Austin’s claims against all Defendants. The parties
5
have agreed to suspend any interim deadlines in the case. Each party will bear its own fees and
6
costs.

In addition, the parties respectfully request that the Case Management Conference
8
currently scheduled for March 7, 2017, be reset for April 28, 2017, or a date thereafter that is
9
conducive to the Court’s calendar.
