PLEASE TAKE NOTICE that Plaintiff MAYER HOFFMAN McCANN, P.C. (“MHM”)
22 and Defendant CAMICO MUTUAL INSURANCE COMPANY (“CAMICO”), by and through
23 their respective counsel, hereby stipulate and agree pursuant to Rule 41(a)(1)(ii) of the Federal
24 Rules of Civil Procedure to the dismissal with prejudice of all claims and counter-claims by both
25 parties in this action.

Each party shall bear its own attorneys’ fees, costs and expenses.

MHM and CAMICO also agree to pay its share of the jury fees as ordered by the Court.
