On April 1, 2015, Plaintiff Maximo Rivera filed the instant complaint. To date, no proof
13
of service of the summons and complaint has been filed. “If a defendant is not served within 120
14
days after the complaint is filed, the court – on motion or on its own after notice to the plaintiff –
15
must dismiss the action without prejudice against that defendant or order that service be made
16
within a specified time.” Fed. R. Civ. P. 4(m).
17
Accordingly, pursuant to Rule 4(m), the Court ORDERS Plaintiff to show cause, in writing
18
and no later than July 7, 2015, why this case should not be dismissed for failure to serve within the
19
time required by Rule 4(m). Notice is hereby provided to Plaintiff that the Court may dismiss this
20
case if no responsive declaration is filed. Thus, it is imperative that the Court receive a written
21
response by the deadline above.

The July 2, 2015 Case Management Conference is VACATED.
